Commercial Terms & Conditions

1. These Terms and Conditions apply to Mike Hodges Photography's (hereafter referred to as MHP or MHP's) Commercial Services only. Separate Terms and Conditions apply to the Wedding and Domestic product ranges. These terms and conditions cannot be changed except by written agreement.

2. Client Privacy

MHP will endeavour to keep all client information confidential and secure as long as such actions do not interfere with MHP's work, as a photographer, for the client. If the client has any specific privacy issues they are requested to inform MHP, in writing, before a booking is made for MHP's services.

3. Booking

By booking MHP's services the client is agreeing to the Commercial Terms and Conditions as laid out here. These Terms and Conditions can only be changed by written agreement prior to a booking being made.

4. Payment Terms

Please note that an electronic copy of the invoice will be emailed to the client as soon as it is raised. A physical copy will be sent by first class mail.

a. Payment is due 30 days from the invoice date.

b. Any issues with the invoice must be raised within the first 7 days from the invoice date.

c. MHP reserves the right to claim interest on overdue payments at a rate of 8% above the Bank of England base reference rate in accordance with the Late Payment Of Commercial Debts (Interest) Act 1998.

d. MHP reserves the right to take late payers to court and use a licensed debt recovery organisation to recover outstanding fees.

5. Copyright

Unless otherwise agreed, and paid for, the copyright of all images resides with MHP. The client is granted a limited license for the use of the images. Details of which are agreed in writing with the client as part of the booking process. MHP reserves the right to use the images, produced as part of the client shoot, for advertising MHP's services anywhere in the world.

6. Additional Charges

In addition to the quoted price for a client shoot there may be further charges to cover extra hours (or part thereof), extra travelling, parking fees and other miscellanea.

7. Rejection

There is no right to reject images on the basis of style, composition or subjective issues.

8. Photographer's Liability

In the highly unlikely event of total failure of photographic equipment, or its loss or other unforeseen circumstance MHP's liability will be strictly limited to a complete refund of all monies paid at that time. MHP cannot be held accountable for acts of god, adverse weather conditions or the failure to attend of third parties (such as models etc).

9. Photographs & Digital Images

Photography is a subjective medium. Whilst MHP will endeavour to ensure all images, colouring etc, match the original subject matter as closely as possible no guarantee can be made concerning exact colours of clothing, people, objects and all other items.

10. Licensing

MHP will include as standard the normal Commercial Use license as shown below.

Mike Hodges Photography grants (Client Name) the limited use of all images taken (Insert date) at (Insert Location) for the following uses: Advertising in print and all electronic media, product imagery for physical and electronic catalogues and editorial applications.

11. Pricing Variations

Please note that coverage required for Christmas Eve, Christmas Day, Boxing Day, New Years Eve and New Years Day all attract a premium charge. Please contact MHP for further details.

12. At this time MHP is not VAT registered.
